RTM Consulting, LLC, a Belcan Company and its affiliated entities and subsidiaries (collectively “RTMC”) provide services and information to individuals and our business customers (collectively, the “Services”). These Services include www.rtmconsulting.net and www.resourcemanagementinstitute.com (our “Sites”) and consulting, training, recruiting and other professional Services provided to our business customers. This Privacy Policy describes how we collect, use, share, store, or otherwise process your personal information in connection with the Services.

We process your personal information only when we have an appropriate basis. For example, we may process your personal information as necessary to provide Services that are subject to terms you have accepted, such as our Sites’ terms and conditions, https://resourcemanagementinstitute.com/legal-notices/ (the “Terms”), when necessary to comply with legal obligations, pursuant to your consent, or for purposes of pursuing our legitimate interests (such as providing and improving products and services, fixing bugs, performing analysis and analytics, communicating with you, preventing fraud, enforcing legal claims, and security purposes) if doing so is consistent with your rights and appropriate to the context.

Collection of Personal Information

When you use the Services, we may collect or receive personal information including the following:

Contact information, such as your name, e-mail address(es), mailing address(es), the state and country in which you reside, and telephone number(s).
Your login credentials if registering for or logging in to any of our Services.
Your areas of interest.
Your photo.
Your job title.
Geolocation information.
Information about your company, such as company name, the number of employees at your business, and industry type.
Comments and other information you submit in connection with RTMC blog posts, social media accounts, public forums, or surveys.
Payment information, including credit card number, debit card number, or other payment card information.

When you use the Services, we may automatically collect information, such as the following:

Device identifiers, including Apple and Android device identifiers.
IP address.
MAC address.
Browsing activity on our Sites, including movements and preferences on our Sites, the date and time you access the Site, and pages accessed.
Websites you visit, including referring websites (the Internet address of websites from which you link to our Sites).
The device technology you are using.
Your browser version, screen resolution, and operating system.
Search inquiries using a Site search function.
Information you download.
Webinar registration and views.

We use automated technology to collect information in connection with the Services, including personal information. The automated technologies we use include the following:

To make RTMC Sites work properly, facilitate access to our Sites, and personalize your experience, we may assign your computer or device one or more “cookies.” A cookie is a small data file that our Sites save on your computer or mobile device when you visit our Sites, respond to surveys, participate in polls, or otherwise use the Services. For example, it enables our Sites to remember your actions, browsing activities, favorite content, and preferences (such as clicking “Remember me” during login). Whenever you sign into our Sites, we will record your user ID in a cookie file on your computer or device.

We use a combination of Google Analytics, marketing automation, and cookies on our Sites that identify your computer to help us analyze traffic patterns on our Sites as well as to provide you with a better experience by showing you content that matches your interests, improving content, and making the Sites easier to use.

Through the use of a cookie, RTMC may also automatically collect information about your online activity on our Sites, such as the web pages you visit, the links you click, and the searches you conduct.

Google Analytics uses cookies to help RTMC analyze how visitors use its Sites. The information generated by the cookies about your use of RTMC Sites includes your IP address, and will be transmitted to and stored by Google on its servers.

Google will use this information for the purpose of evaluating your use of our Sites, creating reports on website activity, and providing other services relating to Internet usage. Google may also pass this information onto third parties when required to do so by judicial or administrative process or otherwise to the extent required by law, or when such third parties process the information on Google’s behalf.

If you so choose, you may be able to opt out by turning off cookies in the preferences settings in your browser, or by downloading and installing the Google Analytics Opt-Out Browser Add-On from http://tools.google.com/dlpage/gaoptout.

Should you wish to not have cookies enabled when using our Sites, you may be able to adjust your browsers settings accordingly. However, this may cause issues in accessing information where authorization is required. Additionally, you can set your user preferences on your profile on our Sites to control how cookies are set.

Some internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. These features are not yet uniform, and we do not support browser do-not-track signals.

RTMC may use other standard Internet technology, such as web beacons (also called “clear GIFs” or “pixel tags”), locally stored objects (often referred to as “flash cookies”), and other similar technologies, to deliver or communicate with cookies and track your use of our Sites and content presented via the Sites. RTMC may also include web beacons in email messages or newsletters to determine whether messages have been opened and acted upon. The information RTMC obtains in this manner enables customization of the programs and services RTMC offers, and measures the overall effectiveness of RTMC’s online content and advertising campaigns. We use web beacons/clear GIFs/pixel tags to track how users are interacting with our content and monitor the effectiveness of our communications.

Additionally, we may record, photograph, or livestream RTMC-sponsored live events. Therefore, you may be included in photographs, video recordings, or audio recordings that we create, collect, or receive if you attend one of these events.

With respect to personal information that we receive from or on behalf of our business customers as a result of the Services we provide to them, RTMC acts as the “processor” of such personal information. In those cases, we collect, receive, use, and disclose personal information at the direction of our business customers. The types of personal information we collect, and how we use and disclose that information, will generally align with the descriptions provided above in this section on Collection of Personal Information and below in the sections on Use of Personal Information and Disclosure of Personal information.

Use of Personal information

We may use personal information we collect or receive about you for purposes including the following:

To provide Services to our users and customers.
To communicate with you and provide you with information that you request from us or which we feel may interest you, including newsletters, white papers, company updates, survey reports, and invitations to events.
To market our Services and improve and personalize marketing and advertising efforts.
To enroll you in Services or free trials.
To improve our membership experience.
Administering, protecting, and improving our Services and our systems.
To better understand the preferences of our Site visitors.
To identify server problems.
To compile aggregated statistics about Site usage.
To help personalize your experience when using our Services.
To operate, evaluate, and improve our business.
To enforce our policies, Terms, or rights arising from any agreement entered into between you and RTMC and to carry out our contractual obligations.
To protect the rights, property, or safety of RTMC, our affiliates, our users, our customers, and others.
To investigate or prevent unlawful activities, fraud, or misuse of the Services.
To comply with any court order, law, or legal process and respond to lawful requests from public authorities, including to meet national security or law enforcement requirements.

Disclosure of Personal Information

We may share your personal information as follows:

Within the RTMC group of companies.
With trusted business partners, such as system integrators, distributors, business customers, and referral partners, and any other party specifically identified on the page on which you submit your information.
With contractors, service providers, and other third parties we use to support our business operations. For example, we use service providers to provide web hosting services, SaaS applications for customer relationship management and data analytics, payment processing, and marketing automation tools.
To comply with any court order, law, or legal process and respond to lawful requests from public authorities, including to meet national security or law enforcement requirements.
To enforce our policies, Terms, or rights arising from any contracts entered into with you and to meet our contractual obligations related to the processing of your personal information.
To protect the rights, property, or safety of the RTMC group of companies, our customers, our users, or others.
To provide Services to our users and business customers.
In connection with a prospective or actual sale, merger, transfer, or other reorganization of all or parts of our business.

We also may post or livestream (including through social media channels and our Sites) video or audio recordings, photographs, and other media that we create, collect, or receive in connection with RTMC-sponsored live events.

We reserve the right to fully use and disclose any information that is not personally identifiable (such as aggregate statistics and survey results).

Choices and Access

You may choose not to provide the personal information we request. However, not providing information we request may restrict your ability to use certain features or functionality of the Services.

You may be able to opt out of the collection of certain information through automated technologies as described in further detail above in the Collection of Personal Information section.

If you believe personal information you have submitted through our Sites is no longer accurate, current, or complete, and you wish to update it, please send an e-mail to info@rtmconsulting.net. Upon appropriate request we will usually be glad to update or amend your information, but we reserve the right to use information obtained previously to verify your identity or take other actions that we believe are appropriate.

Security

Transmissions over the Internet are never 100% secure or error-free. However, we take reasonable steps to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction.

Data Retention

We store personal information for as long as we reasonably need it to fulfill the purposes for which it was collected. We will also retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

International Data Transfers and Privacy Shield Participation

RTMC may transfer your personal information to the United States and other countries that may not have the same data protection laws as the country in which you reside. RTMC participates in and has certified to the U.S. Department of Commerce that it complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (collectively, the “Privacy Shield Framework”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. RTMC is committed to subjecting to the Principles of the Privacy Shield Framework all personal information received from EU member countries and Switzerland in reliance on the Privacy Shield Framework. If there is any conflict between the policies in this Privacy Policy and the Privacy Shield Framework Principles, the Privacy Shield Framework Principles shall govern. With respect to personal information that RTMC receives pursuant to the Privacy Shield Framework, RTMC will remain liable for processing of that information by RTMC’s agents, unless RTMC establishes that it is not responsible for the event giving rise to the damage. The Federal Trade Commission has jurisdiction over RTMC’s compliance with the Privacy Shield Framework.

Inquiries and Complaints Process for Privacy Shield Data and Data Processed in the EEA or Switzerland

If you reside in an European Economic Area (“EEA”) member state or Switzerland, and your personal data are transferred to the U.S. pursuant to the Privacy Shield: In compliance with the Privacy Shield Principles, RTMC commits to resolve complaints about our collection or use of Users’ personal information. EEA and Swiss individuals desiring to request access to their personal information or with other inquiries or complaints regarding our Privacy Policy or practices should first contact RTMC at: info@rtmconsulting.net. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, you may contact JAMS, our U.S.-based third-party dispute resolution provider, (free of charge) through the following web site: https://www.jamsadr.com/eu-us-privacy-shield. Under certain conditions, more fully described on the Privacy Shield website https://www.privacyshield.gov/article?id=ANNEX-I-introduction, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.

Under the Privacy Shield Framework, we are responsible for the processing of personal data we receive and subsequently transfer to a third party acting as an agent on our behalf. RTMC complies with the Privacy Shield Principles for all onward transfers of personal data from the EEA and Switzerland, including the onward transfer liability provisions.

If you are located in the EEA or Switzerland, and we process your information in an EEA member state or Switzerland: you may have additional rights to request access to, correction of, erasure of, or the transfer of your personal information, as well as the right to object to or restrict the processing of your personal information. You may exercise these rights, if applicable, by contacting us at info@rtmconsulting.net. Individuals located in the EEA or Switzerland also have the right to lodge a complaint with an EEA or Swiss supervisory authority, as applicable.

Where we are processing data received from or collected on behalf of our business customers: RTMC collects information under the direction of, and receives information from, its business customers and may have no direct relationship with the individuals whose personal data it processes under these circumstances. If you are a customer or employee of one of our business customers and would like to make an inquiry or complaint, please contact the business customer that you interact with directly.

Amendments

We reserve the right to change, modify, add or remove portions of this Privacy Policy from time to time and in our sole discretion, but will alert you that changes have been made by indicating on the Privacy Policy the date it was last updated. When you visit our Sites, you are accepting the current version of this Privacy Policy as posted on the Site at that time. We recommend that users revisit this Privacy Policy on occasion to learn of any changes.
